Testator definition

What is a Testator?

A testator is a person who has created a last will and testament. More specifically, the will must be in force at the time of the person’s death. To be valid, a will must have been created by a testator who is of sound mind, and who is not under duress and is free of coercion; if not, a court may declare the document invalid.

A female testator can be referred to as a testatrix, though the word “testator” can apply to either sex.

A person who dies without having created a will is considered to have died intestate.
