A trade name is the name under which an organization performs its business. This name differs from the legal name of the entity. A trade name is known as the “Doing Business As” (DBA) name. Trade names are useful when an entity with a nondescript legal name wants to operate under a different name that more fully exemplifies the nature of the business. For example, Acme Restaurants might have a trade name of Jolly Roger’s Caribbean Pulled Pork, which is a much more descriptive name. A trade name is usually registered with the government of the state in which a company is incorporated.
